Welcome to WearMind, an AI-powered t-shirt design platform. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and WearMind ("we", "us", or "our").

WearMind provides an AI-powered platform that enables users to:

  • Save, manage, and share designs
  • Access design tools and features
  • Participate in community features

Eligibility

Age Requirement

You must be at least 16 years old to use WearMind. By using our service, you represent and warrant that you meet this age requirement.

Account Registration

To access certain features, you must create an account by providing:

  • Valid email address
  • Secure password
  • Accurate profile information

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

User Conduct and Acceptable Use

  • Misleading or fraudulent content

Prohibited Activities

❌ Attempt to:

  • Hack, reverse engineer, or compromise the platform
  • Scrape or automatically collect data
  • Create fake accounts or impersonate others
  • Interfere with other users' access
  • Bypass payment or credit systems
  • Distribute malware or viruses
  • Manipulate platform features or ratings

Commercial Restrictions

❌ You may not:

  • Resell or redistribute AI generation credits
  • Use the platform for unauthorized commercial purposes
  • Compete with WearMind using our service

Violation of these terms may result in account suspension or termination.

Intellectual Property Rights

WearMind's IP

All platform code, design, features, branding, and technology are owned by WearMind and protected under copyright, trademark, and other intellectual property laws.

You do NOT acquire any ownership rights by using our service.

Your Content and Designs

Content You Create

  • Text Prompts: You retain ownership
  • Uploaded Images: You must have rights to use them
  • Generated Designs: You own the output, subject to our license

License You Grant Us

By using WearMind, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Process and generate your designs
  • Display public designs in galleries and showcases
  • Use anonymized designs for marketing and promotion
  • Improve our AI models (aggregated and anonymized)

For Private Designs: We only use them to provide services to you.

Commercial Use of Designs

You may use generated designs commercially, provided:

  • The design doesn't infringe on others' rights
  • You comply with applicable laws
  • You don't misrepresent the origin or ownership

AI-Generated Content Considerations

Important Notes:

  • AI-generated images may have unique copyright considerations
  • You are responsible for ensuring your prompts don't reference copyrighted material
  • Some jurisdictions may have different rules for AI-generated works
  • We make no warranties regarding the copyright status of AI outputs

Third-Party Content

If you incorporate third-party content (images, text, ideas) into your designs, you must:

  • Have proper licenses or permissions
  • Comply with applicable terms and conditions
  • Not violate any copyrights, trademarks, or other IP rights

Pricing and Payments

Free Credits

  • 20 free credits on sign up (enough for 4 designs)
  • Access to basic features
  • Standard resolution exports
  • Community gallery access
  • Pro: $9.99/month - 200 designs/month, priority generation
  • Unlimited: $29.99/month - Unlimited designs, highest priority
  • Enterprise: Custom pricing - API access, white-label options

Payment Terms

  • All prices are in USD unless otherwise stated
  • Subscriptions auto-renew unless cancelled
  • Payments processed through Stripe/PayPal
  • We reserve the right to change pricing with 30 days notice

Refunds

  • Free credits: Non-refundable (they're free)
  • Subscriptions: Pro-rated refunds within 7 days of purchase
  • Credits: Non-refundable once purchased
  • Fraud/Error: Full refund if payment was unauthorized

Cancellation

You may cancel your subscription at any time:

  • Via account settings
  • By contacting support
  • Cancellation takes effect at the end of the billing period
  • You retain access until the period ends

Content Moderation and Removal

Our Rights

We reserve the right to:

  • Review and moderate user-generated content
  • Remove designs that violate these Terms
  • Suspend or terminate accounts for violations
  • Report illegal activity to authorities

Content Removal Process

  1. Automated Detection: AI scans for prohibited content
  2. User Reports: Community can flag violations
  3. Manual Review: Our team reviews flagged content
  4. Action: Remove content and/or warn/suspend user

Appeals

If your content is removed, you may appeal by:

  • Emailing support@aishirt.app
  • Providing explanation and evidence
  • Waiting for review (typically 5-7 business days)

Privacy and Data Protection

Your use of WearMind is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

  • We comply with GDPR and CCPA
  • We do not sell your personal information

WearMind complies with the Digital Millennium Copyright Act (DMCA). If you believe your copyright has been infringed, please see our DMCA Policy for reporting procedures.

Repeat Infringers: We terminate accounts of users who repeatedly infringe on others' copyrights.

Disclaimers and Limitations

Service Provided "AS IS"

WearMind is provided on an "as is" and "as available" basis. We make no warranties or representations about:

  • Service availability, reliability, or uptime
  • Accuracy or quality of AI-generated designs
  • Fitness for any particular purpose
  • Error-free operation

No Guarantees

We do not guarantee that:

  • Designs will be commercially viable
  • AI generation will always produce desired results
  • The service will be uninterrupted or error-free
  • Designs are free from IP infringement (you must verify)

Limitation of Liability

To the fullest extent permitted by law, WearMind shall NOT be liable for:

Direct Damages:

  • Loss of profits, revenue, or business opportunities
  • Data loss or corruption
  • Cost of substitute services

Indirect Damages:

  • Consequential, incidental, or punitive damages
  • Damages resulting from use or inability to use the service
  • Third-party claims arising from your designs

Maximum Liability: Our total liability is limited to the amount you paid us in the 12 months before the claim, or $100, whichever is greater.

Exceptions: These limitations do not apply to:

  • Gross negligence or willful misconduct by WearMind
  • Liability that cannot be excluded under applicable law
  • Personal injury or death caused by our negligence

Indemnification

You agree to indemnify, defend, and hold harmless WearMind, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the service
  • Your generated designs or content
  • Your violation of these Terms
  • Your infringement of any intellectual property or other rights
  • Your violation of applicable laws

Termination

By You

You may terminate your account at any time by:

Upon termination:

  • Your subscription will be cancelled
  • Your designs may be deleted (download them first!)
  • You will lose access to paid features immediately

By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent activity
  • Your account is inactive for 24 months
  • Required by law or court order
  • We cease operating the service

We will provide notice when possible, but may terminate immediately for serious violations.

Effects of Termination

Upon termination:

  • All licenses you granted to us end (except for publicly shared content)
  • You must stop using the service
  • Certain provisions survive termination (IP, disclaimers, indemnification)

Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date.

For Material Changes:

  • You will have 30 days to review and accept changes
